Sont surtout poursuivis pour blasph\u00e8me les \u00e9l\u00e9ments subversifs, les radicaux politiques consid\u00e9r\u00e9s comme des ennemis de la soci\u00e9t\u00e9 et de l&rsquo;Etat <a id=\"anote3\" href=\"#note3\">[3]<\/a>. N&rsquo;y voyant qu&rsquo;all\u00e9gories, il est d\u00e9clar\u00e9 coupable de blasph\u00e8me par le juge Raymond et condamn\u00e9 \u00e0 quatre amendes (une par ouvrage litigieux) avec emprisonnement jusqu&rsquo;au paiement et \u00e0 un an d&#8217;emprisonnement <a id=\"anote6\" href=\"#note6\">[6]<\/a>. Ne pouvant r\u00e9gler, Woolston reste enferm\u00e9 jusqu&rsquo;\u00e0 sa mort <a id=\"anote7\" href=\"#note7\">[7]<\/a>.<\/p>\n<p align=\"justify\">En 1778, le juriste William Blackstone, un des plus \u00e9minents th\u00e9oriciens de Common Law, d\u00e9finit le blasph\u00e8me comme un \u00ab\u00a0<em>d\u00e9lit contre Dieu et la religion<\/em>\u00a0\u00bb consistant \u00e0 nier \u00ab\u00a0<em>son existence ou sa providence\u00a0\u00bb<\/em>, ou prof\u00e9rer des \u00ab\u00a0<em>paroles outrageantes sur le Christ<\/em>\u00ab\u00a0, des \u00ab\u00a0<em>railleries ind\u00e9centes sur les saintes \u00e9critures<\/em>\u00ab\u00a0, des \u00ab\u00a0<em>propos tendant \u00e0 en inspirer le m\u00e9pris<\/em>\u00a0\u00bb ou \u00ab\u00a0<em>les tourner en ridicule<\/em>\u00a0\u00bb <a id=\"anote8\" href=\"#note8\">[8]<\/a>. Les poursuites sont souvent initi\u00e9es par des organisations priv\u00e9es <a id=\"anote10\" href=\"#note10\">[10]<\/a>. La Soci\u00e9t\u00e9 pour la suppression du vice, cr\u00e9\u00e9e en 1802, intente r\u00e9guli\u00e8rement des actions contre des \u00e9diteurs dans le but de d\u00e9fendre la morale et la religion <a id=\"anote11\" href=\"#note11\">[11]<\/a>. Elle engage ainsi des actions \u00e0 l&rsquo;encontre de Richard Carlile. En 1819, elle lui reproche d&rsquo;avoir r\u00e9\u00e9dit\u00e9 une oeuvre de Thomas Paine, \u00ab\u00a0<em>Le Si\u00e8cle de la raison<\/em>\u00a0\u00bb (<em>The Age of Reason<\/em>, 1793-1794), qui attaque la place de la religion dans la soci\u00e9t\u00e9 <a id=\"anote12\" href=\"#note12\">[12]<\/a>.<\/p>\n<p align=\"justify\">Durant son proc\u00e8s, Carlile se d\u00e9fend seul et lit \u00ab\u00a0<em>Le Si\u00e8cle de la raison<\/em>\u00a0\u00bb \u00e0 voix haute devant une salle d&rsquo;audience exasp\u00e9r\u00e9e <a id=\"anote13\" href=\"#note13\">[13]<\/a>. Il est condamn\u00e9 \u00e0 trois ans de prison et au paiement d&rsquo;une amende de 1500 livres (<em>R v. Carlile<\/em>, 1819) <a id=\"anote14\" href=\"#note14\">[14]<\/a>. Pendant son incarc\u00e9ration, il continue d&rsquo;\u00e9crire des articles pour le journal \u00ab\u00a0<em>The Republican<\/em>\u00a0\u00bb , publi\u00e9 par son \u00e9pouse Jane, puis sa s\u0153ur Mary jusqu&rsquo;\u00e0 ce que l&rsquo;une et l&rsquo;autre soient emprisonn\u00e9es <a id=\"anote15\" href=\"#note15\">[15]<\/a>. Dedicated to the Archbishop of CARLILE!<\/em> \u00bb, publi\u00e9 par Thomas Tegg, 1819, <em>The British Museum<\/em><\/figcaption><\/figure>\n<p align=\"justify\">A partir des ann\u00e9es 1830, les critiques contre les liens entre l&rsquo;Eglise anglicane et l&rsquo;Etat se renforcent avec le d\u00e9veloppement du radicalisme et de la presse <a id=\"anote18\" href=\"#note18\">[18]<\/a>.<\/p>\n<p align=\"justify\">En 1841, la d\u00e9finition du blasph\u00e8me conna\u00eet toutefois une \u00e9volution. Dans l&rsquo;affaire <em>R. v. Hetherington<\/em>, le juge Lord Denman privil\u00e9gie une interpr\u00e9tation plus \u00e9troite, s&rsquo;attachant davantage \u00e0 la forme qu&rsquo;au fond pour qualifier le d\u00e9lit <a id=\"anote19\" href=\"#note19\">[19]<\/a>. D\u00e9sormais, la contestation des grands principes de la chr\u00e9tient\u00e9 est tol\u00e9r\u00e9e \u00e0 condition d&rsquo;\u00eatre faite de mani\u00e8re mod\u00e9r\u00e9e, ne pas \u00eatre offensante, insultante ou ridicule <a id=\"anote20\" href=\"#note20\">[20]<\/a>.<\/p>\n<p align=\"justify\">A compter de 1825, le d\u00e9lit de blasph\u00e8me n&rsquo;est plus passible de la peine de mort en Ecosse. Il reste sanctionn\u00e9 par une amende et\/ou une peine d&#8217;emprisonnement <a id=\"anote21\" href=\"#note21\">[21]<\/a>.
